Saavedra: State enters action in STF to overturn law that requires supply of special insulins



The government of Santa Catarina filed a direct action of unconstitutionality in the Federal Supreme Court (STF) questioning the state law that provides for mandatory provision by the government of special insulins. The bill was vetoed by Governor Raimundo Colombo, but maintained by deputies.

Among the arguments listed by the state government is the absence of a cost source for the purchase of medicines. In an initial estimate, the State Department of Health pointed out cost around R $ 50 million.

In Joinville, however, the municipal secretary has been claiming that the supply is the responsibility of the State because of Federal Court decisions. State law would be another matter. The municipality no longer intends to buy special insulins.






Group of diabetics already protested
The problems in buying and distributing insulin, as well as products and supplies used to treat diabetes, have already led a group of people to protest in front of the City Hall in early July. They were patients and relatives of patients and members of the Diabetes Association of Joinville (Adijo), who were affected by the delay in the purchase of special insulins. Today, 1,024 people in the city depend on the medicine delivered at the pharmacy-school.

Special insoles have a high cost and a bottle can sell for more than $ 100. Some diabetics take high doses of insulin and the bottle lasts less than a week. Since 2006, the Health Department of Joinville has purchased the medicines with municipal funds.

At the time, the State Department of Health (SES) reported that 16 types of insulin were supplied to the region of Joinville. With regard to the law passed by the Legislative Assembly in April, which deals with the free distribution of insulin analogues, under the responsibility of the State Department of Health, it is being questioned by the State Attorney General's Office (PGE). Meanwhile, SES has already made itself available to the municipality of Joinville to assist in the procedure for purchasing analogues.
